TRUST

Do you need to Draft a Trust?
Do you need to Amend a Trust?
Do you wish to be advised on which structure to choose for your business?
Do you wish to be advised on Beneficiary Entitlement?

Trust is a type of special legal arrangement whereby a trust property or asset is created by a settlor, to be held by the trustee for the benefit of the beneficiary. The trust system may seem to be a complex one, since while a trust is not classified as a separate legal entity, it is,however, treated as a separate entity for tax purposes. This creates potential liabilities for the trustees while holding the trust for the full benefit of the beneficiary.

It is important to note that there are many different forms of trusts with their own distinctive features and advantages, such as fixed trusts, discretionary trusts, hybrid trusts to name a few.

Each and every one of the trust structures serve different purposes, and they vary from one another. The different purposes include wealth distribution, investment, tax minimisation, charity purposes and more. In a commercial sense a trust has the ability to safeguard your business and personal assets and even act as a strong barrier between any potential litigations and your assets since after the trust relationship is established all the trust assets will be separated from the settlor.

At Apostles Legal, we are experienced in drafting a wide variety of Trust Deeds and advising on the different trust structures to find one that is the most compatible with every individual or business client’s needs.

More specifically, Apostles Legal specialises in Family Trusts and Self-Managed Superannuation Fund (SMSF) Trusts.
