In our legal system, the solicitor/client relationship has long been recognised as a fiduciary relationship. The term ‘fiduciary’ means trust, so in a fiduciary relationship one person (the client) places his or her confidence, good faith, reliance and trust in another (the solicitor), whose aid, advice or protection is sought in some matter.

What are duties?

A fiduciary relationship creates many legal duties for the person in whom the trust has been placed. Generally this person must act in the best interests of the other. In relation to their clients, solicitors must:

act honestly and fairly in a client’s best interests
act with due skill and diligence, reasonable promptness and courtesy
maintain a client’s confidences
avoid conflicts of interest
communicate effectively and promptly with clients
follow a client’s instructions.








<Personal Background> Young seoung Jang

Young has worked as a commercial lawyer for a number of years in Sydney and Seoul.

He is a passionate, commercially astute lawyer. He has represented his corporate/business clients in a wide range of matters including company establishment, acquisition, imports/exports, business franchising, sales and purchases of businesses, commercial leasing, and intellectual property.

After a few years of experience at private law firms, Young worked as an in-house lawyer for Samsung Heavy Industries in Seoul. He managed a wide range of high profile corporate contracts pertaining to shipbuilding, joint ventures, cooperation agreements, NDAs, subcontracts, loan agreements, and human resources.

Personally, he has a deep interest in human rights, particularly refugees issues and wrote his master's thesison the subject of the 1951 Refugee Convention at Waseda University, Tokyo.

He also worked as at United Nations High Commissioner for Refugees (UNHCR) and United Nations for Children's Fund (UNICEF).

He considers integrity, dedication and optimism as utmost importance for his practice.
